KUAC STAFF: DRUGS & TOBACCO

DRUG-FREE WORKPLACE

State law and the policy of the University of Kansas and KUAC prohibit the unlawful possession, use, manufacture or distribution of alcohol or drugs by students and employees on its property or as part of its activities. The University is committed to a program to prevent the illegal use of drugs and alcohol by students and employees. Any student or employee found to be using, possessing, manufacturing, or distributing controlled substances or alcohol in violation of the law on University or KUAC property or at University or KUAC events shall be subject to disciplinary action in accordance with applicable policies of the State of Kansas, the Board of Regents, the University of Kansas, and/or KUAC.For KUAC employees, KUAC will take appropriate personnel action for such infractions, up to and including termination. Students who violate this policy will be subject to sanctions, up to and including suspension or expulsion from the University. Students and employees are reminded that illegal manufacture, distribution, dispensing, possession or use of controlled substances may also subject individuals to criminal prosecution.

As a condition of employment, all employees of the KUAC shall abide by the terms of this policy statement and will notify KUAC of any criminal drug conviction for a violation no later than five days after such conviction. KUAC will initiate personnel action, up to and including termination, within thirty days of receiving notice of such conviction. Employees may also be required to satisfactorily participate, at their own expense, in a drug abuse assistance or rehabilitation program before being allowed to return to work. For purposes of this policy, “conviction” includes a finding of guilt (including a plea of nolo contendere or a diversion agreement) or imposition of sentence, or both, by any judicial body charged with the responsibility to determine violations of the federal or state criminal drug statutes.The illegal use of drugs is not subject to the provisions of the Americans with Disabilities Act.The term “controlled substances” as used in this policy means those substances included in Schedules I through V as defined by section 812 of Title 21 of the United States Code and as further defined by regulation 21 CFR 1300.11 through 1300.15. The term does not include the use of a controlled substance pursuant to a valid prescription of other uses authorized by law.

SMOKING POLICY

It is the intent of this policy to provide a safer, healthier environment for all KUAC staff, students and visitors by placing limitations on smoking and chewing tobacco.KUAC has an interest in fostering health and safety awareness. Many individuals report discomfort when exposed to secondhand smoke.By acknowledging that smoking is a controllable hazard and by adopting a policy to restrict smoking, KUAC demonstrates its commitment to promoting a healthy and tobacco-free work environment.Smoking and chewing tobacco are not permitted in any area of Allen Fieldhouse, Horejsi Family Athletic Center, Anderson Strength Center, Parrott Athletic Center, Anschutz Sports Pavilion, and Wagnon Student Athlete Center. At Memorial Stadium, Hoglund-Maupin Stadium, Jayhawk Field and Super Target Field smoking and chewing tobacco are not permitted in any enclosed area or in the general seating area.A No-Smoking policy is implemented for the front entrances on the North and East side of Allen Fieldhouse; North side to Parrott Center and Wagnon Student-Athlete Center as well as the balcony area of Wagnon Student-Athlete Center; and the West side entrance to the Anschultz Pavilion/Anderson Strength Center.The outside smoking area for KUAC employees will be the patio entrance area between Allen Fieldhouse and the Parrott Center on the South side. The general public will be allowed to smoke in the front entrance areas during game events. Smoking areas must be at least twenty (20) feet from the entrance.

SMOKING POLICY DURING ATHLETIC CONTESTS

I. SMOKING POLICY: State law prohibits smoking in state owned buildings, including any area of Allen Fieldhouse, Wagnon Student-Athlete Center, Parrott Athletic Center, Anschutz Sports Pavilion, Horejsi Family Athletic Center, and Anderson Strength Center. Smoking is not permitted in any enclosed area or in the general seating area of Memorial Stadium, Hoguland Ballpark, Super Target Field or Jayhawk Field. For these venues, smoking will be permitted only on the exterior ramps or walkways behind the seating area.

II. Any individual found violating this policy will be asked to stop smoking by game management staff members.

Procedure:1. Inform the individual of the smoking policy and ask the individual to stop smoking.2. If the individual refuses, make the following statement.”My name is ______________, I am a member of the KUAC Game Management staff. Your actions are disrupting the business of the athletics department and violating the state and/or University smoking policy. I am requesting you to leave the building. If you do not comply with my request, an officer will escort you from the building.

If the individual fails to comply, contact the game management supervisor who will ask the KU police to remove the individual for violation of K.S.A. 3721 (criminal trespass).
