* Kansas Athletics, Inc. does not assume any risk, liability, or responsibility for the authenticity or the authorship of any tangible property, services, or experiences identi?ed in the auction program. All items, property, and services are auctioned "as is." Kansas Athletics, Inc. does not make any representations or warranties of any kind or nature, expressed or implied, with respect to the auction items, property, services, or experience. The items are represented to the best of Kansas Athletics’ knowledge.
* Items will be sold to the highest eligible bidder recorded at the close of bidding on each applicable item/experience. Bids will not be accepted after the close of the auction. The winning bidder will be notified via e-mail, and may also receive a text message confirmation of their winning bid. All winning bids are ?nal and will become the proceeds of Kansas Athletics, Inc. There are no refunds or exchanges. The winning bidder shall be deemed to have purchased the offered item, package, and/or experience, subject to all applicable conditions including, but not limited to, (a) the assumption of the risk and responsibility of the purchased package/experience, and (b) making full payment (including any applicable surcharge, taxes, and delivery costs) for the purchased package/experience. No item, package, or experience may be redeemed for cash.
* Some experiences may have time certain dates upon which the winning bidder must opt to use the experience. Kansas Athletics, Inc. is not responsible if the winning bidder fails to use an experience before the expiration date. Some experiences may also require a waiver of liability when redeeming with the experience provider(s). Kansas Athletics, Inc. is not a representative of the experience provider(s) and cannot guarantee, release, nor assume the waiver for the winning bidder. Please bid accordingly.
* An auction payment may qualify as a charitable contribution deduction/receipt. Kansas Athletics, Inc. will not be providing a charitable donation receipt. Please consult your tax advisor regarding deductibility of your purchase and any other tax questions.
* Neither Kansas Athletics, Inc. nor the University of Kansas, shall be liable for any loss or damage suffered (including, but not limited to, consequential loss) or personal injury suffered or sustained in connection with an item, package, or experience, except for any liability which cannot be excluded by applicable law. By placing a bid, the bidder acknowledges and agrees that neither Kansas Athletics, Inc., the University of Kansas, nor either’s agent(s) who assist in conducting this auction are liable for any negative results from the use of the purchased item, package, or experience.
